Despite our best efforts to move all your belongings with care, occasionally an item may be damaged or lost.

The motor carrier act of your province states that a carrier of household goods is liable, to certain defined limits, for any loss or damage to goods accepted by it or its agents. You may choose between certain established levels of liability that you wish the carrier of the household goods to accept.

The liability protection coverage from movers is "NOT" insurance in the normal sense of having a specific policy written under the auspices of an insurance underwriter. The act permits you to choose to make a written declaration of the value of your shipment on the Bill of Lading. This value and terms stated on the reverse of the Bill of Lading will then be used when determining the amount of any loss or damage should that occur to the items shipped.

Please read the following pages which explain the two liability protection options and select your choice carefully. You may want to contact your insurance agent or discuss your choice further with the carrier to ensure that your household goods are fully protected against further risks.


Option "A"

Standard Protection

You do not pay extra for this basic type of liability protection however, in the event of a claim for damage and/or loss, the maximum amount of carrier liability is sixty (.60) cents per pound, per article. For example, if your night table is damaged by the carrier in the move and you have chosen this option, the carrier is not liable for more than $24.00 (night tables usually weigh 40 lbs). If the table requires repairs, the cost will more than likely exceed the amount you are paid.

If the damaged or lost item(s) was packed in a carton by our company, the maximum amount payable is calculated on the total weight of the packed carton. A $200.00 vase weighing 5 lbs that is packed in a china carton (carton has an average weight of 65 lbs.) has a maximum protection of $39.00.

If a total loss were to ever occur (by fire for example), your maximum protection would be 60 cents for each pound of actual weight of your entire shipment of household goods.

For example, 8000 lbs X 0.60 cents = $4800.00 maximum liability.

Jay's, like all movers, has the option of repairing, replacing or arranging a fair cash settlement up to the maximum protection amount per pound per article under this option.

Although this liability protection is the least favorable, it may be adequate if you have alternate coverage on your household possessions that provides a complete all risk protection during the entire moving process.

If this type of protection is selected, the relevant portion of your Bill of Lading must be completed, initialed and signed as follows:

Important: If you do not complete and sign the Bill of Lading as shown in the sample above, we are obliged under the law, to apply coverage under Option B and collect the additional charges for increased protection.


Option "B"

Replacement Protection

Many families want the peace of mind and the advantage this additional protection offers. That's why our Van Line designed a Replacement Protection Plan for maximum coverage at an affordable price.

Choosing this option means that when something is broken or damaged by a Jay's carrier and it is their fault, the carrier has the option to repair, cash settle or replace it up to the item's current North American market value for like kind and quality without depreciation. This protection is limited only by the amount of valuation you select. It is important therefore, that you recognize and establish the realistic replacement value of all your possessions to be moved.

Our only requirement is that your shipment be protected to not less than a minimum value of $5.00 per pound of the actual weight of your household goods.

For example, if the total weight of your household items is 10,000 pounds, you must apply a replacement coverage of not less than $50,000.00. (10,000 x $5.00 = $50,000)

If you choose this type of liability protection, be sure that it is adequate enough to protect you should loss/damage or even total loss occur.

Single items of extraordinary value (excess $5,000) should be listed separately on the Inventory of Items High Value form and the replacement cost of each item identified separately on/with the Bill of Lading.

A certified appraisal must be attached to the Bill of Lading as proof of value for high value or antique items.

The total value of these items must be in addition to the required minimum coverage of $5.00 per pound of household goods weight.

To assist you in determining the amount of replacement coverage best suited to your needs, we have included a personal inventory guide. Once completed, this inventory will assist you in the event a claim should occur during your move. This guide will also assist you when you renew your homeowners policy at your new residence.


Motorized Vehicle Protection

A limited protection coverage applies to motor vehicles, trailers, campers, snowmobiles, motorcycles, boats or motors. Maximum damage or loss liability shall be limited to current market values (depreciated) at origin on date of shipment. If the parties cannot agree on the value, then the monetary worth published in the issue of the Canadian Used Car Valuation book or similar publication current on date of loading shall apply.

When an antique or collectors motorized vehicle exceeds the current published market value, a certified appraisal must be attached to the Bill of Lading as proof of value. Pictures of the vehicle can prove very helpful when accompanying an appraisal.

The total value of motorized vehicles must be in addition to the required minimum coverage of $4.00 per pound of household goods weight. When more than one vehicle is shipped, each vehicle must be noted separately on the Bill of Lading and identified by year, make and value declared.

If damage should occur to your vehicle(s) during transportation, clear exceptions to any new damage must be recorded, at the time you take possession of your vehicle(s), on the "Vehicle Condition Report" for consideration of any claim.

Storage

Jay's provides two types of Storage: Storage-in-Transit (S.I.T.) and Long Term Storage (L.T.S.)

Storage-in-Transit is for a period of not more than 60 days and must be in connection with a long distance move. The terms and conditions of carriage on the Bill of Lading and the liability protection coverage you have chosen apply only during the long distance move and S.I.T. (60 day) period. Then, your shipment reverts to "Long Term Storage" and is subject to the terms, conditions and liability protection options applicable between you and the warehouse carrier.

Long Term Storage is storage for any length of time, not related to a long distance move or any length of time over 60 days in relation to a long distance move. L.T.S. services are offered by all Jay's agents and separate rules, regulations and rates apply depending on the Agency and services required.

Goods placed in Long Term Storage are not covered under the protection provided on the Jay's Bill of Lading for transit. Further protection can be obtained from the Agent or from your own insurance company.


Claim Procedures

In the unfortunate event of a loss or damage claim, Jay's Moving and Storage is committed to providing prompt and equitable restitution.

If you experience a claim, immediate contact with your local Jay's agent at destination is essential. Your local agent's name, address and telephone number at destination is indicated on your Bill of Lading.

The claim form must be submitted and received by the Agent at destination or Jay's Moving and Storage within 60 days after you receive your possessions or the carrier is excused from liability.

Our Agents utilize only selected craftsmen to ensure quality repair and restoration. Because we believe in prompt action, our Agents have the authority to settle most claims on the spot. Our experienced customer service representatives at our Corporate Head Office in Oakville, Ontario are always available to ensure customer satisfaction.

Whichever protection option you select, all claim settlements are subject to the conditions of carriage printed on the reverse of the Bill of Lading and the type of liability protection you chose for your move. Your moving consultant will be pleased to explain the regulations.


Non-Admissable Items

Household goods carriers are prohibited by law from transporting the following goods:
  • Explosives: ammunition including, bullets, shotgun shells, etc.; railroad or road flares; fireworks; detonators; blasting caps
  • Gases: any gases under pressure or liquefied; propane, quick start; oxygen; acetylene; helium; household or industrial fuel; aerosol cans; hair spray; anti-perspirant; paint cleaner; butane lighters; propane tanks
  • Oxidizers: bleach; disinfectants; organic peroxides; fertilizers; pool chemicals; hair bleach; chlorine in any form
  • Flammable Solids: matches, fuel tablets, barbecue starter pellets, hay or straw, wood chips
  • Liquids: wine, beer, preserves
  • Flammable Liquids: gas; cleaning fluid; lighter fluid; paint; paint thinners; barbecue starter; glues; resins; kerosene; naphtha; acetone; alcohol; lamp oil
  • Corrosives: oven cleaner; toilet cleaners; liquid plumber; drain cleaner; household cleaners; lye; acids (sulphuric, hydrochloric, nitric, muriatic); car, boat or motorcycle batteries
  • Poisons: pesticides, herbicides, cygon, fumigants, wood preservatives, creosote, photographic chemicals
  • Items subject to spontaneous combustion: oily rags, charcoal


Non-Protected Items

The following goods are excluded from cargo protection
  • Jewellery
  • Coins
  • Stamps
  • Documents
  • Watches
  • Currency
  • Precious Stones/Metals
  • Perishable Articles (frozen food, plants & pets, etc.)
Liability with respect to items such as photographs and other similar objects is limited to the value of the film, albums, etc. No allowance will be made for items of sentimental value, as they do not have a cash equivalent amount. You are strongly urged for your own protection to take such items with you.


Mechanical Damage

It is the shipper's responsibility to make preparation arrangements before transit of items of a mechanical nature. These items include, but are not limited to clocks, stereos, large appliances (washers, dryers, refrigerators, freezers, etc.) and any item which has mechanically moving parts. If these items are not properly prepared, damage can occur through no fault of the carrier. The carrier is not liable for mechanical damage unless the cause is directly attributed to external damage or the carrier's technician improperly serviced the item at origin.

Owner Packed Cartons

Jay's Moving and Storage cannot assume responsibility for damage to the contents of cartons that are not packed and unpacked by the contracting carrier, his Agent or employees. If there is clear evidence noted on the delivery documents, of mishandling the cartons, or the exterior of the carton is damaged, resulting in breakage of the contents, the carrier will accept responsibility for obvious damage. This rule also applies to items that are not necessarily of a fragile nature but should have been packed professionally to reduce the risk of damage. Such items include, but are not limited to: mattresses, box springs and dresser mirrors.


Sets

Damage to or loss of a complete set or unit when only part of such set is damaged or lost, in which event the carrier shall only be liable for repair or recovering of the lost or damaged piece or pieces.


Inherent Vice

The carrier cannot be held responsible for damages to the type of items which by their very nature are subject to damage due to changes in temperature. Cold weather is a particular problem with certain types of possessions such as vinyl or plastic items or coverings. Similarly the lacquered finish on furniture items, such as pianos, may shatter in extreme cold. There is virtually nothing that a carrier can do to protect the furnishings against this factor during transit in extreme cold weather. You should discuss this matter with your moving consultant to determine how best to handle the situation. Generally, it may be best to leave those items at origin to be stored in a climate controlled warehouse for later shipping in more clement weather.
